1. General information

These Terms & Conditions govern access to and use of the ROAKFIT website and the purchase of gym machines, accessories and related services. By browsing the site, requesting a quotation or placing an order, you accept these Terms.

2. Products and quotations

ROAKFIT specialises in premium fold-away gym systems and fitness accessories. Product descriptions, dimensions and images are provided for guidance. Due to the bespoke nature of many installations, final specifications may be confirmed in a written quotation.

Prices displayed on the website may be indicative. A formal quotation may be required for Gym Closet units, custom finishes, shipping and installation. Prices are shown in the applicable currency for your selected region and may include or exclude VAT as indicated.

3. Orders and contract formation

• A request for quotation does not constitute a binding contract.
• A contract is formed when we confirm your order in writing (email) after acceptance of the quotation and, where applicable, receipt of payment or deposit.
• You confirm that the information provided (delivery address, contact details, space measurements) is accurate.

4. Payment

Payments are processed securely through our payment partners (including Stripe) or by bank transfer as agreed in the quotation. We do not store full card details on our servers. Ownership of goods passes to the customer upon full payment, subject to delivery terms.

5. Delivery and installation

• Delivery times are estimates and may vary depending on customisation, manufacturing and logistics.
• International shipping may be subject to customs duties, import taxes and local fees payable by the customer unless otherwise agreed.
• Professional installation, where offered, will be specified in the quotation. Access requirements and site readiness are the customer’s responsibility unless otherwise agreed.

6. Right of withdrawal (14 days)

If you are a consumer in the European Union / European Economic Area purchasing online, you generally have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason, in accordance with Directive 2011/83/EU and applicable national law.

• To exercise withdrawal, notify us clearly at legal.vontadefavorita@gmail.com within the 14-day period.
• You must return the goods without undue delay and in any event within 14 days of informing us of withdrawal, unless we arrange collection.
• Goods must be returned unused, complete and in suitable packaging. You may be liable for diminished value resulting from handling beyond what is necessary to establish the nature and functioning of the goods.
• Refunds will be issued using the same payment method within 14 days of receiving the returned goods or proof of return, as required by law.
• Exceptions: the right of withdrawal may not apply to clearly customised or bespoke goods made to your specifications, or other exceptions permitted by consumer law. This will be stated in your quotation where relevant.

7. Warranty

Under EU consumer law, you are entitled to a legal guarantee of conformity for goods. In addition, ROAKFIT products may benefit from a commercial warranty as specified in your order documentation.

• Legal guarantee: consumers are generally entitled to remedies for lack of conformity existing at the time of delivery (typically for a minimum period under applicable national law).
• Commercial warranty: duration and coverage (structure, mechanisms, finishes) are confirmed in writing with your purchase.
• Warranty does not cover damage caused by misuse, improper installation (if not performed by us), unauthorised modifications, or normal wear and tear.
• To claim warranty support, contact legal.vontadefavorita@gmail.com with your order details and a description of the issue.

8. Returns outside the withdrawal period

Returns outside the statutory 14-day withdrawal window may only be accepted at our discretion or where required by law (e.g. defective products). Defective goods will be repaired, replaced or refunded in accordance with applicable consumer rights.

9. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Portuguese or EU law. Subject to the foregoing, our liability for claims arising from the sale of products is limited to the price paid for the relevant goods, to the maximum extent permitted by law.

10. Intellectual property

All content on this website (including logos, designs, texts, images and product concepts) is protected by intellectual property rights belonging to VONTADE FAVORITA - LDA / ROAKFIT or its licensors. You may not copy, reproduce or use such content without prior written permission.

11. Governing law and disputes

These Terms are governed by the laws of Portugal, without prejudice to mandatory consumer protection rules of your country of residence within the EU/EEA. Consumers may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
